Actually, the penalties for marijuana possession and use are not much different in Texas than other states. While it is considerably more stringent than some states, such as California, it is also slightly more lenient than others, such as North Carolina. In fact, in Texas, if you have not had a prior drug conviction, you will likely get probation even for a felony charge of marijuana possession. An individual may have up to a pound of marijuana in their possession and not serve any jail time. However, they are required to attend a drug treatment program. If there is not a treatment program in the jurisdiction of the court, the judge may waive this requirement. That being said, if the individual is charged with a more serious crime, such as selling drugs or having repeat offenses, the penalties are considerably more harsh.
