No, medical marijuana is not currently legal in New York; however, there is a large movement working to have marijuana legalized in the use of medical treatments for patients in a great deal of pain, such as those with cancer or AIDS. Other states in the U.S. have legalized medical marijuana and it creates a unique problem. Although some state may legalize possession and use of marijuana on their level, it is still a federal crime; therefore, individuals may still be charged with federal drug possession or other related offenses. Those that advocate for the legalizing of marijuana for medical purposes or otherwise have also encouraged correcting this catch 22 within the legal system. Others feel it minimizes the criminal stigma of drug use when certain people in society are excused from the law.
