I was arrested in Arizona for possession of an extremely small amount of marijuana.  I’ve never been in any trouble with the law before.  What can I expect to happen to me?

In Arizona, marijuana possession of less than two pounds without the intent to sell it is a class 6 felony.  However, if you have no prior history of criminal activity, the court may decrease the charge to a class 1 misdemeanor.  A class 1 misdemeanor has a maximum jail sentence of six months.  However, you may also be eligible for probation instead of jail time.  Typically, if you do not have any criminal record, you are very likely to receive probation.  However, you will also probably have a fine to pay of up to $750 or three times the value of the marijuana you were in possession of, whichever is greater.  You will also have community restitution, also known as community service, of at least 24 hours.
