How long an individual spends in jail as deadly conduct punishment depends on what they were doing to be charged. Deadly conduct is considered an offense when someone acts recklessly that places someone else in imminent bodily injury. Every state is different in how these charges are punished. However, in Texas, this basic charge is only a Class A misdemeanor, which is punishable by a fine up to $4000 and/or up to one year in jail. However, if he discharged a firearm toward a person, vehicle or building, the deadly conduct charge becomes a third degree felony. This is also the case if he points a firearm at someone, whether he believes it to be loaded or not. A third degree felony and is punishable by between 2 and 10 years in prison and a fine of up to $10,000.
