I was in a store a few weeks ago and when I tried to leave, they wouldn’t let me go. They said I had been shoplifting- they said the clerk identified me the week before as the person who stole a bunch of cold medicine. I didn’t take anything and they didn’t find anything on me that day, but they claim they have security tapes of me stealing, plus the clerk’s statement, and they say they are going to press criminal charges. What do I do?

Answer:

The first thing you should do is contact a criminal attorney and let him know you have been falsely accused of shoplifting. Generally, it is a good idea to talk to an attorney before providing any statements to the police  or before answering questions about what occurred, as you may involuntarily incriminate yourself. Your attorney will help you to determine whether the prosecution can potentially bring a case against you for shoplifting. If your attorney discovers the prosecutor has no evidence against you, he can also file a request for the court to dismiss the case and charges.
