Colorado residents are not required to obtain a permit to purchase handguns, shotguns or rifles. Gun owners do not have to register their weapons, but dealers are required to keep records of any sales, rentals or exchanges of handguns. Anyone who wishes to carry a concealed handgun must apply for a permit, which if approved is valid for a period of 5 years. In March 2011, House Bill 1205 was approved by the Colorado House Judiciary Committee; this bill would make it legal for Colorado residents to carry a concealed weapon without a permit.

Colorado Concealed Carry Permit Eligibility

The sheriff shall issue a permit to carry a concealed handgun if the applicant meets the following criteria:

  • Is a legal resident of the state of Colorado and is over the age of 21
  • Does not regularly abuse drugs or alcohol
  • Is able to demonstrate proficiency with a firearm
  • Has not been convicted of perjury concerning a concealed weapons application
  • Is not currently the subject of a restraining order
  • Has not been convicted of a felony offense or a domestic violence crime
  • Does not have mental health problems

The Sheriff can deny a permit to anyone reasonably believed to be a danger to self or others in the community.

Colorado Concealed Weapons Violations

The laws in the State of Colorado allow a concealed and loaded weapon to be carried on a resident's property or in his or her vehicle. Violations occur when residents carry weapons in other locations such as schools or unlawfully conceal their weapons.

Plea Options for Criminal Offenses

The District Attorney’s office may be willing to let the offender plead to a lesser offense in exchange for entering a guilty plea. However, those who wish to avoid a criminal conviction can plead innocent and proceed to trial. The prosecution has the burden of proof to show the judge or jury that the defendant is guilty beyond any reasonable doubt.
