What are the various underage dui penalties and sentencing for minors that are caught just drinking, or drinking and driving?

Our son is seventeen and has a license and his own car.  We know that he drinks beer with his friends and then drives.  We have talked to him about the safety concerns as well as the legal underage DUI consequences.  He says we are wrong and that because he is a minor, nothing serious will happen to him legally if he is caught.  Is that right?

Since your son is not listening to you, you should consult with a lawyer experienced in DUI criminal matters to help him understand that he is very wrong.  Being a minor, the legal consequences of DUI are oftentimes more severe than for an adult.  In either case, the results are serious -  fines up to $2000, impoundment of the vehicle, revocation of license, attending driving safety courses, possible jail time, and the like.  For minors, those same consequences can occur but additional charges can be brought including minor in possession of alcohol, soliciting alcohol from an adult or use of a false ID (depending on how he gets the beer), and distributing alcohol to minors (if he gave beers to his other friends who are minors as well.)  An attorney experienced in DUI criminal defense can help your son understand that underage DUI consequences can be MORE severe than for an adult.
