Question:

I have 2 kids that are 17 and 18 years old, I guess they were out with some friends looking for a camping spot and got lost. A state trooper ended up pulling them over and charging them with trespassing even they tried explaining they were lost. What should they do?

Answer: (1)

Was the trespassing sign clearly visible or was it visually obstructed on the path your kids took to enter into that area? Was it government, state owned property or private? If the property is private owned, you can attempt to reason with the owner explaining the kids didn’t know where they were going. It would then be up to them to pursue or drop the charges.

If it is government or state owned, you would have to make a court appearance and explain your case. It would be very helpful hiring a Criminal Defense Attorney to have the charges reduced, or dropped all together in the case the Trespassing Sign was not clearly visible under “unfairness.”
