Question:

I have a medical marijuana card in California, and for vacation later this summer I’m driving north up the Pacific coastline through Oregon and Washington.  Since medical marijuana is legal in all three states, can I take marijuana from California to Oregon and Washington?  If I run out, will I be able to purchase it while I’m up north?

Answer: (1)

No and no.  If you transport medical marijuana across state lines and are caught, you will certainly need the services of an experienced criminal defense attorney.  You may only possess, transport, purchase, cultivate and/or use medical marijuana in the state of California.  Note however that cannot transport marijuana on an airplane even if you remain within California’s borders.  If your medication is found during the TSA screenings, you could be detained and turned over to state or federal authorities depending upon the quantity of the drug found in your possession.   Similarly, if you transport medical marijuana across state lines you could face federal charges as well as charges made by the arresting jurisdiction.  And, even within your home jurisdiction, the more marijuana you transport the more you run the risk of a possession with intent to sell charge if you are stopped by the police.
