Question:

I was at a bar with my girlfriend and some friends when a couple of drunk guys kept giving us trouble. One of them kept making passes at my girlfriend while I was in the bathroom and it made me uncomfortable. Later on as we left my girlfriend told me one of them had touched her. I got really upset and when I saw one of the guys outside I punched him a couple times in the face before I got arrested by police. I am now being charged with Simple Assault in California. What type of sentencing and penalties am I facing?

Answer: (1)

Simple Assault in California can be looked up as California Penal Code Section 240-241. It is usually charged with a misdemeanor and maximum jail time of 6 months and/or a fine for $1,000. You may be able to plea to the judge to get a reduced sentence. A criminal defense attorney would be able to help.
