I was dating this girl for almost a year that I was pretty close with. We never officially became a couple, but we definitely did engage in mutually consented sexual acts. I know for a fact there is now way I raped her but she has been threatening me and is ready to go to the police. Can I be arrested by her simple allegation? What are the chances I’ll be prosecuted?

Answer: (1)
Unfortunately, when a victim verbally identifies the suspect as the rapist who committed the crime, the police can arrest you with “probable cause.” This means they don’t need hard evidence and a simple accusation can get you arrested.
However, you cannot be prosecuted unless there is evidence and testimonies that “without reasonable doubt” point to you committing the crime. This is a very serious matter and Rape convictions are treated with felony charges, jail fines, a permanent criminal record, and may even possibly land you on an identified sex offender list. You should definitely speak to your attorney immediately in taking the right measures to prevent this charge. Gather any and all evidence you have in the mean time, as well as witnesses willing to contest on your behalf.
