Question:

There has been a string of local robberies and because I matched the description and was caught near the scene of one of the recent crimes, I was apprehended and jailed for about a week. They later caught the real perpetrators and let me go. I bared a lot of distress with myself and between my family, not to mention consequences with employment. Can I sue for damages?

Answer: (1)

If the police had probably cause to make the arrest and believe you had committed the crime, it is very difficult to sue them for wrongful arrest or false imprisonment. Most of the cases that go to court do not win however there have been several that do. These usually get public attention from the media as they are more rare.

You can consult the exact fact and details of what had occurred with a Criminal Defense Attorney to see if you have a strong enough case to go to court and win.
