I am being charged with Mortgage Fraud, I was a loan officer. What can I do and what charges will I be facing?
I was a Loan Officer from 2004-2007. I worked on behalf of a local Mortgage Broker and basically followed the instructions of my Manager. I do not wish to incriminate myself in anyway online, but let’s just say I am being charged with fraud due to complaints from a couple of previous clients, al though I do not exactly agree it was fraud. My court hearing is coming up. Should I hire an attorney?

Mortgage Fraud is being taken on very seriously throughout the country and there have been dozens upon dozens of fraud cases (aside from the major banks) popping up. Many real estate agents, loan officers, and brokers have been charged and convicted with running huge fraud rings for mortgage loans. Some of the tactics they used were forging signatures, inflating property values, not properly explaining the loan, and fraudulent qualification measures.
However, fraud cases involving Mortgage Loans are document intensive. Thus, in order to be convicted, there must be explicit evidence showing that you deceived your clients and committed fraudulent activity. If you end up being convicted, you can count on a Felony charge, up to 1-3 years in Jail, and probation afterwards. The damage caused by fraudulent loans is quite massive considering loans can quickly add up to the million plus dollar value range. In addition, you’ll be liable to pay for any damages and you have caused the victims.
I suggest you quickly contact a Criminal Defense Attorney which specializes in defending clients for Mortgage Fraud. They know the complex laws and legal procedures around this area very well and will be able to expertly defend you.
