Identity theft may be just a simple misdemeanor for some states, but in the state of Idaho, this is quite serious, where some types of identity theft are classified as felonies. This is best exemplified by the Idaho Identity Theft Law – Idaho Code subsections 18-3124 to 3128, which exhaust all possible cases of Idaho identity theft and their corresponding punishments.
Generally, a person is only guilty of misdemeanor if he/she violates codes 18-3124, 18-3125A or 18-3127. However, if the retail value of the items in question pertaining to these codes exceeds $300, then the violator is charged with felony. For violators of codes 18-3125, 18-3126 or 18-3126A, the charge is automatically felony, regardless of the amount related to the crime.
For misdemeanor charges, the fine can be as large as $1,000, while the corresponding jail time can be as long as a year in the county jail. However, both punishments can be given to a violator depending on the gravity of the case. For felony charges, the fine can be 50 times larger or $50,000, and the jail time can be 5 times longer or 5 years inside a state prison. Still, both punishments can be given to a violator depending on the gravity of the case.
