I sold something on craigslist about a few months ago and the idiot I am, I let the buyer pay me with a check. It cashed and everything was fine until the police contacted me saying I cashed a fradulent check and now they are investigating me. How likely is it that I will be in trouble even though I didn't do anything to my knowledge?

Answer: (1)
In the court of law, you are not guilty until proven so. In check fraud cases, in order to be charged, convicted, and prosecuted, there must be strong paper trailed evidence that clearly shows that you were involved in the fraud without a reasonable doubt. You should be able to collect the proper paper trail of the transaction through the financial institution you cashed the check. You should also get copies of e-mail and phone conversation trails between you and the buyer who had gave you the check. Hiring an attorney would be very important to help defend your case as they are familiar with fraud rules and investigation procedures. If you are innocent, an attorney should be able to proove that.
