Question:

I used a fake gun and robbed a liquor store for $300. The police are now after me on suspicion of handheld armed robbery. How long will I go to jail for?

Answer: (1)

Once you use a weapon, fake or not, and commit an act of robbery, you will be charged for armed robbery. When weapons are used, there will be sentencing enhancements. Since the gun you used was fake, the sentencing enhancement may not be as great as if it were a real gun, but your penalties will be enhanced in either case. This will be considered as a Felony charge and you will undoubtedly serve jail time and pay fines of up to $20,000. You should consult with a Criminal Defense Lawyer immediately who may be able to assist in helping you plea bargain and receive a less severe sentencing and penalty, especially if this is your first criminal offense.
