What are penalties and sentencing for Embezzlement for first offense?
I am being charged for embezzling my college out of about $8,000 that was put into a charity account and they are now pressing charges and maybe expelling me from the school. I am able to pay the money back immediately, can do I do anything to avoid a criminal record?

It is difficult to say if you can avoid a charge all together. You would have to negotiate with your school and pay them back the entire money, but I am not sure if you would avoid an expulsion from that. However, the good news is you will more than likely not go to jail as embezzlement cases for relatively lower amounts of monetary damage go from criminal courts to civil. You can look forward to paying twice the fine amount back, plus additional penalties, and either a misdemeanor or felony. You should consult with a Criminal Defense Attorney immediately to consider your defense options.
