Many people who get pulled over because the officer believed they’re driving under the influence take the field test and the blood or breath test.  And once they’ve done that, if the officer’s perception of the person during the field test points at inebriation, or the blood or breath comes back with anything present, then the person arrested probably assumed the best way to handle the situation is jus to plead guilty and get it over with. They failed the tests, so there’s no way to stop a conviction, or so they think.

A surprising number of DUI cases never even make it to the conviction phase because a good DUI lawyer can often find problem within the case itself and end up having it dismissed. Here are just a few of ways this can be done. 

  • The manner in which the field test was given could be incorrect.
  • Possible fault can be found with the breathalyzer machine
  • Contamination can be shown in a blood sample that’s been handled improperly
