The majority of criminal cases in this country are defended by public defender agencies. In NYC we have a variety of public defender agencies and also a program where attorney represent indigent people and the state picks up the tab. I am often asked if it is better to go with a private attorney. Generally the answer is yes. The vast majority of public defenders are hard-working lawyers who are trying to do the best for their clients. However, each year it seems their caseloads go up and their resources go down. I personally know publid defenders who are handling over 150 cases at a time. No lawyer can effectively do that. It is just not reality.

Proper Criminal Defense Takes a Lot of Work

The amount of work it takes to properly review criminal cases is time consuming. No two cases are alike, even cases where the same exact charges are charged. Witnesses must be interviewed, motions must be filed, and if the client is in jail, visits will be necessary. Due to their crushing caseload public defenders do not have the time to do all that. It is a sad reality, but it is a reality. If you are facing criminal charges I strongly recommend hiring a private attorney. The consequences of a conviction can be severe, even in the most minor cases. Once you retain the attorney make sure to communicate with him that you expect top-notch service and prompt answers to your questions. After all, you are paying for his services.
