In a Wisconsin murder trial, the prosecuting attorney is recruiting women who are 5 feet 8 inches tall and weigh 140 pounds to prove that a murder suspect did, in fact, kill his wife by drowning her in a toilet. He stands accused of poisoning the 28-year-old woman with migraine relief drugs and drowning her in the bowl. However, the man claims that his wife was depressed and committed suicide by taking the pills. He said that he found the woman slumped over the toilet, which was filled with vomit.
According to the prosecution, the woman’s head could not have fallen into the toilet bowl in such a way, as to allow her to drown. It would have needed to be forced from behind. However, the criminal defense attorney argues that the experiment that the prosecuting attorney wants to run is “junk science.” Indeed, the case was thrown out of the Wisconsin Supreme Court once before because the first round of toilet tests were performed by an “expert” who had faked his credentials.
The defense says that allowing the prosecution to demonstrate how women’s heads fit in a toilet is ridiculous and that it is unfair expert testimony.
