Illinois DUI zero tolerance laws apply to anyone under the age of 21 who is driving a motor vehicle. The Illinois zero tolerance program, which is referred to as "use it or lose it" was instituted in 1995 in an attempt to stop teenage drunk driving. Because those under the age of 12 are not permitted to drink, the Use it or Lose It or Zero Tolerance program set the required BAC level at 0.0 for teen drivers. Any teen who is found to be driving with any alcohol in his or her system at all can lose his or her license under the zero tolerance laws (although exceptions are made if a small amount of alcohol is in the teen's system because it is present in a medication or because the teen had to sip alcohol for a religious ceremony). 

If a teen is in violation of the zero tolerance laws, he may lose his license for up to three months for a first offense, and for up to one year for a second offense. If the teen driver refuses to take a breathalyzer test, he can lose his license for six months the first time this occurs and two years the second time. These penalties and rules are in addition to the standard DUI laws as well, which means that a teen who is driving with a BAC above the regular legal limit of .08 can also be subject to all DUI penalties that would be issued to any driver.
