Question:

I run a small business and had trouble getting a building inspector to come out to inspect my new construction. In gratitude of the building inspector showing up on a Saturday, I gave him a $50 gift card to a restaurant. Will I get in trouble for this?

Answer: (1)

It is unlikely you will get in trouble unless the inspector reports this as you trying to gain a favorable inspection decision. It is never good to give gifts or services to a government employee who is in position to make a critical decision either for or against you, as it can be considered a bribe. Bribery law is defined as “offering, giving, receiving, or soliciting of any item of value to influence the actions of an official or other person in charge of a public or legal duty.” If you feel inclined to show gratitude, you should first ask if it is ok, and only do so after the “administrative action” has taken place. If you have been accused of bribery, you should speak with a lawyer immediately to understand your rights.
