Voluntary Manslaughter

Killing another human being is considered to be one of the most serious offenses that a person can do. Murder is a more serious charge than manslaughter, because a murder charge requires that someone actually had the intent to kill someone. There are two different types of manslaughter, voluntary and involuntary. Involuntary manslaughter implies that the use of deadly force was not planned but occurred during the process of committing an unlawful act. Voluntary manslaughter means that someone did have the intent to kill, but there are extenuating circumstances involved in the situation. The charge requires that proof of provocation or diminished capacity must be present. It usually involves a situation in which a normal person loses control of his or her emotions and kills another human being as a result of that loss of control.
