Vehicular Manslaughter Charges

Drivers who are involved in a wreck where someone died and they are found to be criminally negligent because of driving under the influence, failure to obey traffic laws or distracted driving could face vehicular manslaughter charges. The person who died could be a pedestrian, a passenger in the driver’s car or a person in another car involved in the wreck. Some states have different terms for vehicular manslaughter but it is the same crime. In most states, vehicular manslaughter charges are misdemeanors in most cases. In Georgia, the charge is called first degree homicide by vehicle. It is a felony and anyone convicted must serve at least one year in prison. The sentencing range is 3 to 15 years and depends on the circumstances. In Oregon, if the driver was drunk, two years are added to the sentence. Almost all states require some prison or jail time for vehicular manslaughter.
