Vehicular Assault

Vehicular assault occurs whenever someone operates a motorized vehicle in a way that intends to cause or does cause serious bodily injury. Vehicular assault can also be found in cases where an individual operated a motor vehicle while under the influence of alcohol or drugs and caused bodily injury to another person. Reckless driving that causes injury will also often be increased to a vehicular assault charge, which is a felony sentence. In most states there are different levels or categories of vehicular assault charges that typically consider the severity of the injury as well as the type of driving that caused the injury to occur. In most areas the driver's past record as well as the presence or absence of any type of intoxication at the time of the arrest will also pay a big factor in sentencing. Most states also include a mandatory loss of driver's license for a set period, often up to one year, without provisions for driving for work purposes.
