Trespassing Crime

A trespassing crime is when anyone is on someone’s property without their permission. The law states that the offender had to know that he or she was not allowed to be there. They could have known because: Signs were posted on the property saying ‘no trespassing; They were told by the property owner not to be on the property. Protestors can be arrested for trespassing if they stray from the street or sidewalk onto private property. In rural areas, property owners have problems with hunters trespassing on their land pursuing the “big kill.’ Homeowners should call the police instead of trying to deal with trespassers on their own. Trespassing crimes are misdemeanors. Sentencing can range from a short stay in the county jail to a fine. Judges will consider whether it is a first offense. However, the offender will have the arrest and conviction on their record unless their sentence includes a provision that would erase the arrest once the offender completes his or her sentence.
