Trespassing can be either a civil or a criminal offense. The most common definition of trespassing is an unlawful entry onto someone else’s property. In this case, unlawful means without permission. Even if no harm is done to the property by the trespasser, he or she has still broken the law, especially if the area is posted. There are some people who would have the right to go onto someone’s land, posted or not, and not be considered a trespasser. The mail delivery person is a good example. However, if this person was to do something besides deliver the mail, such as enter your home without your permission, he or she is trespassing. Criminal trespassing involves willfully entering and remaining in or on someone’s property, entering said property after being told specifically that you are not welcome there, or entering property or a structure that has been locked or otherwise restricted from casual entry by others. Civil trespassing is different in that occurs when some sort of property damage has happened as a result of someone’s trespassing.
