Simple Assault Penalties

Simple assault has several definitions. In some states it is the threat of assault. In others, it is touching. The charge can involve physical contact as long as the injuries aren’t severe. Most simple assault penalties are misdemeanors and some do not even involve jail or prison time. In Texas, if the simple assault only involved touching or threats, the penalty is a $500 fine. But if the simple assault involved a family member, the charge is felony. The offender could be sentenced to up to 10 years in prison and pay a fine of up to $10,000. Georgia law defines simple assault as a misdemeanor punishable by up to a year in the county jail and a fine of up to $1,000.
