Simple Assault Charges

Simple assault is a crime in which a person unlawfully intents to do violence against another person; to negligently do violence against another person, especially with a weapon; or to threaten or cause another person to fear imminent violence or bodily harm. In most jurisdictions, the threat to do serious bodily harm must be accompanied by the ability to do such harm. Assault is often not charged when the threat comes from someone who is drunk and incapacitated. Assault is a misdemeanor unless the simple assault is aimed at a law enforcement official or other authority.
