Sexual Battery

In the United States, laws concerning sexual battery can be different depending on what state you are located in. In some states, sexual battery is any sort of physical contact or sexual penetration between two people that each person has not consented to. It is also sexual battery in some states if a person has physical contact or sexual penetration with another person who is somehow mentally incapacitated or physically helpless, and who has not consented to these acts. Sexual battery also occurs if someone sexually penetrates a child under the age of 14 in some states. If a child is over the age of 14, but less than the age of 18, certain special laws apply. If this child and a person who the child normally trusts or sees as an authority, such as a teacher, priest, coach, doctor, counselor, parent or stepparent, or any others who would fall in this category have sexual penetration, then this is also considered sexual battery.
