Resisting Arrest Laws

Resisting laws can be a felony or misdemeanor. Misdemeanor resisting arrest can involve simply pulling away from the officer or lying to him or her. Felony misdemeanor arrest involves an act of violence that injured the officer. Another type of misdemeanor arrest is fleeing to elude a police officer in a vehicle. While fleeing to elude is a misdemeanor in some states, in Minnesota it is felony, punishable by up to three years in prison and a $5,000 fine. Even if you believe that you are unjustly being arrested and the charges are eventually dismissed, you can still face the resisting arrest charge. The sentence for misdemeanor resisting arrest is usually a maximum of one year in jail and/or a $1,000 fine. A felony sentence depends on the injuries the officer received and the previous record of the offender.
