Resisting Arrest

A person who is guilty of resisting arrest is someone who has done at least one of three different things. He or she either managed to get away from law officers who were trying to arrest them. He or she used some sort of force, or told the arresting officer they were going to use force in order to get away from them. He or she gave the arresting officer a form of identification that was fake, or told the officer a name and address other than their own. When someone is charged with resisting arrest, it is a separate charge from whatever the arresting officer stopped them for in the first place. No one can plead self-defense when an officer uses force to stop them from resisting arrest. In fact, resisting arrest normally will cause a person to also commit assault and battery against the office who is attempting to arrest them.
