Reckless driving cases involve a number of scenarios. These include: Improper passing. Did you pass on the right on a busy interstate? Did you pass in a no-passing zone?; Passing a stopped school bus. States have enforced tough penalties on this law because many children have been injured because of motorist who did not use caution while the school bus was loading or unloading; Speeding or driving too fast for conditions. In some states, you must be going 20 miles over the speed limit to be considered reckless; Did you run a traffic light or fail to stop at a stop sign?; Failing to signal properly. Did you not use a turn signal? This can be considered reckless; Failure to yield the right-of-way; Racing. Most reckless driving statutes are not clear as to how reckless driving should be charged. However, the “rule of thumb” is that a motorist is violating at least three of the basic traffic laws to be considered reckless.
