Probation Violations

Probation violations occur whenever an individual that has been put on probation in lieu of a jail sentence somehow breaks or fails to comply with the guidelines as established for the terms of the probation. This occurs when an individual enters a guilty plea and the judge agrees to probation instead of jail time. The terms of probation will vary based on the actual type of charge. For instance, typically alcohol related charges that result in probation state that the individual is not to consume or be around those consuming alcohol. If, during a random urine test or during a routine visit by the probation officer the individual was found to have consumed alcohol or been to a party, the probation would have been violated. Any further violation of any laws, even if unrelated to the original charge will result in a probation violation. Failing to appear for meetings with a probation officer are also violations of the terms of the probation. Violations of probation typically result in revocation of probation, which means the offender must serve the rest of his or her sentence in jail. In some instances the judge may impose longer and stricter probation, depending on the individual in the case.
