Plea

A plea is always used in a criminal case in answer to the charges that are brought against the defendant. There are two ways that a defendant in a court case can plea, which are "guilty" or "not guilty". Of course, all defendants want to have an acquittal, and be officially certified as innocent in the eyes of the law, but unfortunately, it doesn't always happen that way. A law known as Scots Law has changed the titles of the acquittal verdicts to not guilty and not proven. The not proven verdict does not give the accused the right to make use of the double jeopardy rule, however. England and Wales can boast of a legal system that abides by the Criminal Justice Act 2003 and can create an exception to the rule of double jeopardy by allowing for retrials.

Fast Facts

  • The Criminal Procedure and Investigations Act of 1996 allows a type of acquittal known as a tainted acquittal.
  • Today in both England and Wales, when a person enters a plea of not guilty and he or she is acquitted, that person is immediately released from custody.
