Petty Theft Felony

California is one of the few states where petty theft can be a felony. The requirement for a petty theft felony charge is that the offender must have been convicted of a petty theft before. The charge is also called “petty theft with a prior.” The punishment ranges from a year in the county jail to 16 months in prison. The petty theft felony law has been reconsidered since the state’s mandatory “Three Strikes” law took effect after passing in 1994. The law states that anyone convicted of three felonies could serve up to a life sentence in prison. For example, if a person has four shoplifting convictions, three of them could be felonies, meaning a serial shoplifter could spend the rest of his or her life in prison. An attempt to repeal the three strikes law in 2004 failed. Several hundred people are believed to be serving life terms for felony petty theft charges.
