Petty Theft Court

If you are arrested on petty theft charges, you will have to face a judge or possibly a jury on your charges. Petty theft court is usually held on misdemeanor charges. In most states, petty theft penalties are fine up to $1,000 dollars and six months to a year in jail. In petty theft court, you could receive diversion if this is your first offense. You will be given a sentence that usually includes fines and community service. In most cases, you will be required to pay restitution to your victim. As long as you don’t violate any laws during the diversion period, your conviction will be erased. Only California has a provision for felony petty theft, but you must have one prior petty theft conviction on your record. The sentence varies but could be up to six months in jail or 16 months in prison. And you will have a felony on your record.
