Ohio vehicular manslaughter is based on the fact that there was no criminal intent at the time of the incident that caused the death of another person. In other words, the wreck was an accident. The person could have been a passenger in the vehicle the offender was driving or the driver or passenger in another vehicle. Ohio vehicular manslaughter is a misdemeanor. The maximum punishment for misdemeanor in Ohio is six months in the county jail and a $1,000. If police and prosecutors can prove that there was criminal intent, the charge is upgraded to vehicular homicide, a felony. The basis for criminal intent could be the person was operating a vehicle under the influence (called OVI in Ohio), was fleeing police at the time of the accident or was in a stolen vehicle. A vehicular homicide conviction could result in a prison term and fines of up to $20,000.
