Juvenile Murder

Juvenile murder occurs when the individual accused of the murder of another person, regardless of the victim's age, was under the age of 18 years at the time of the offense. The victim must have died as a direct result and intent of the other individual or in the commission of a crime. For example, a fatal shooting that occurred by a person under the age of 18 because of previous intent, planning or premeditation, even if it occurred as a "heat of the moment" killing, is still considered juvenile murder. The same incident that occurred because of the accident discharge of a firearm would be considered manslaughter as there was not direct intent to injury or kill. Juvenile murder sentencing options vary from state to state but may include life without the possibility of parole or significant jail time and then the possibility of parole. In most states, and depending on the nature of the crime, the juvenile may be tried as an adult and be eligible for adult sentencing.
