Indecent Exposure Laws

Indecent exposure laws are defined by each individual state and are typically considered to be misdemeanor types of charges. In most areas indecent exposure is defined as displaying or showing, with the intent for sexual gratification or to cause alarm and offense, the genitals, buttocks or the female breast. This does not include women breastfeeding, nor does it include people in their own private residences being nude or displaying those sexual parts to other consenting adults. Any exposure of the sexual areas of the body is considered serious under indecent exposure laws and can often be included in other offenses, some which may reach the level of felonies. In some areas public nudity in areas designated as nude beaches or nudist retreats may not be indecent exposure, but that depends on the laws for that particular area. These charges typically will include probation, fines and community service and in some cases counseling or awareness programs may be required.
