Incorrigibility

A petition for incorrigibility is filed against a child who is under the age of 17. The minor's parents, guardian, or anyone else who may have custody of the child must file this petition in a court of law. The incorrigibility consists of disobedience to the parents, custodians, or guardians that happens repeatedly or continuously. In order to file the petition, this disobedience must also be accompanied by serious and frequent misconduct that may or may not include criminal actions. The child or youth deemed as incorrigible will then enter the juvenile court system of the town where they live. When a child or youth is considered as incorrigible, the court will question them about any sort of substance abuse by parents or other family members. An affirmative from the minor, and the family members will be questioned about such actions.

Fast Facts

  • Incorrigibility must be considered a serious matter, and parents should think before filing a petition for such.
  • Infractions of parental discipline such as hurting other family members or destroying property are serious. Infractions such as not making a bed, not washing dishes, or talking back are not signs of incorrigibility.
