Forgery Charges

Forgery is imitating, adapting, or making objects, statistics, or documents with the intent to defraud. Generally, copies and reproductions are not considered forgeries unless and until they are willfully misrepresented with the intent to defraud. When money, currency, and consumer goods are forged, it is often called counterfeiting. In the case of records or documents, the forgery is called a false document. Forgery is generally not prosecuted as a crime unless the monetary value reaches a substantial level, usually determined by the authorities investigating the forgery, or it falls into one of the 45 statues in the U.S. criminal code for forgery. In cases of criminal prosecution, the penalties vary by state law, but they can include restitution, fines, jail time, asset forfeiture, and gaining a criminal record. Any victim of forgery can also seek civil action against the perpetrator.
