Felony Theft Sentencing

As with any crime felony theft sentencing depends on the nature of the crime, the offender’s previous criminal record and if the defendant pleaded guilty or was found guilty by a jury. If the theft was more than $100,000, the defendant will likely spend some time in prison or jail. If the defendant stole $500 to $10,000, the jail term could be suspended for a lengthy probation sentence. Most plea bargains result in a lighter sentence for the defendant, even though judges do have certain guidelines they have to follow. Most felony theft sentences include jail or prison terms, probation, restitution, fines and community service. In Florida, a defendant can spend up to 30 years in jail for first degree grand theft. However the maximum penalties can be much higher in some states. In California, petty theft becomes a felony if a person is convicted as second time. Under California’s Three Strikes law, the offender can serve a life sentence if convicted of for felony thefts.
