Felony Murder

With felony murder, you have two things going on at one time. There is some sort of criminal activity that is taking place, and a murder is also taking place at the same time. There are some jurisdictions that call this first-degree murder. Felony murder could be the end result of a bank robbery, or a case of arson, even if the person who was committing the robbery or arson had no idea he was harming another human being. There is a felony murder rule, which states that a case of manslaughter will automatically become a case of this type of murder when someone is accidently killed as a result of the felony. This rule also states that the felon is responsible for every death that took place, be it one or twenty.

  • In a robbery that takes place where one criminal does the killing while the other criminals stand to one side, everyone who participates in just the robbery portion of the crime will be charged with felony murder. If one robber is killed, the other robbers will be held responsible for this death as well.
