Felony DWI

There are several different situations that can result in a DWI or driving while under the influence charge to be increased to a felony level charge. Felony DWI is typically the charge when someone is injured or killed due to a driver with a blood alcohol level of .08 or higher. In some most conditions the blood alcohol level is much less important than the injury or death factor, and even individuals with a slight blood alcohol content that were also driving in a reckless fashion leading to the injury or death can be charged with felony DWI. In situations where someone has more than one DWI charge, especially within a set period of time, the second charge is automatically at the felony DWI level, regardless if there was injury to another person or not. Refusing to complete a blood alcohol test, typically called a breathalyzer, can result in separate charges and may bump a first offense DWI or DUI up to a felony level. Most repeat felony level DWI will result in significant jail time and revocation of the driver's license.
