Felony Burglary

Felony burglary is actually one of the crimes that have changed in its legal definition over the years. In the earliest cases felony burglary occurred when an individual forcibly entered into a residence or building, typically at night, with the intent to do a crime, usually by stealing or other felony type of criminal activity. Felony burglary definitions are now much broader and can include any unauthorized entry into a location with intent to do some type of crime. Generally this will include another felony type of crime, however break and enter is not long required to be considered felony burglary. Crossing a threshold of a building or residence with the intent to commit a crime is technically felony burglary, although intent to commit the other crime has to be established. Felony burglary cases are often enhanced if there was a weapon present, either a weapon brought in by the offender or found at the scene and used to threaten or brought in for the purpose of creating fear.
