Felony battery is a serious offense that is considered and categorized as a violent crime. Felony battery can occur under several different conditions including if a weapon was used in the assault, if there were significant and serious bodily injuries, permanent harm or disfigurement to the victim or if there has been more than one previous battery or assault charge in the record of the offender. In order for a physical contact to rise to the level of a felony battery there must have been actual physical contact, but it can be with the feet, fists or other parts of the body, there does not need to be a weapon used. In some areas battery with a weapon is considered aggravated battery. Aggravated or felony battery also occurs if the offender injured or attacked a woman that was pregnant or that he or she had reason to believe could have been pregnant at the time of the attack. In most cases felony battery will a third degree felony, however aggravated battery can be a second degree felony.
