False Imprisonment Felony

False imprisonment occurs when someone is held against his or her will. The charge differs from kidnapping because there is no element of actually “taking” a person. The offender makes the victim feel as if they cannot leave by: Using words or actions; Confinement by actually keeping them there in some type of constraints. In most states false imprisonment is a felony. But in Wyoming, the charge is a misdemeanor punishable by a maximum of a year in jail and/or a $1,000 fine. In Georgia, False imprisonment felony punishment is up to 10 years in prison. In Florida, false imprisonment is a third degree felony punishable by up to five years in prison and a $5,000 fine. If the false imprisonment involves a child under the age of 13 and certain sexually related crimes, the charge is a first degree felony.
