DUI Penalties

DUI penalties can be many and varied. A lot depends upon the circumstances of the DUI, and the state where the DUI takes place. Each of the fifty states have different laws for DUI, but each recognizes the same blood alcohol level of 0.08. This is the amount that signifies that you are “per se intoxicated”. If you are caught driving under the influence, you can be penalized for the act as a felony, or just as a misdemeanor. The penalty for refusing to have your blood alcohol tested, or for refusing to complete some field sobriety tests given by the arresting officer is the automatic suspension of your driver’s license, usually for a period of 90 days for the first offense. Second or third offenses mean that your license will be suspended for one year and for three years. Many states have laws of zero tolerance, where anyone under 21 years old with a 0.02 blood alcohol level will be arrested for DUI.
