DUI Cases

People who have been stopped by local law enforcement while driving under the influence often wonder what to expect when the time comes to attend court. DUI cases can vary, depending where in the country you live, but they are basically the same no matter where they occur. After your arrest, you will more than likely be taken to jail. Once locked up, you will usually arrange to post bond. When your bond is posted, you will go home and wait for your court date, which could well be a month or two in the future. A DUI attorney can help you prepare for your court date, or arraignment. Here, you will plead not guilty. Your next step is the actual trial, which can be a jury trial or a bench trial. A jury trial includes judge and jury, while a bench trial has only the judge, you, your attorney, and the state’s witness in most jurisdictions. You will either be acquitted or convicted at your trial.

Fast Facts

  • It is always best to plead not guilty, and ask for a jury trial. Doing the opposite on both counts could harm DUI cases.
